"They" in this passage refers to those previously indicated at the end of the prior chapter in Mark (Mark 11:27): "And as He was walking in the temple, the chief priests, and the scribes, and the elders came to Him". Jesus began a dialogue with them at that point, which continued into Mark 12, where Jesus told a parable directed at them (Mark 12:1-11), after which (in Mark 12:12), the text says, "And they tried to arrest Him, but feared the multitude, for they perceived that He had told this parable against them; so they left Him and went away." Verse 13 then says (as noted in the question), "And they (referring again to the chief priests and the scribes and the elders) sent to Him some of the Herodians to entrap Him in His talk."
